In order to qualify as a group in Texas for health insurance, the company must have at least two participants. Participants can either be W-2 employees employed by the company or officers of a limited liability company. Employees who are designated as W-2 employees must work at least 30 hours per week. Key Aspects of Group Coverage

Group coverage in Texas for companies with less than 50 employees is guaranteed issue, which means a company's employees will be offered health insurance coverage regardless of their health history or current health condition. Guaranteed issue does not apply for employers with more than 50 employees.

Carriers can require a specified level of participation from the employees in order to qualify as a group. Typical required participation is 75%, but carriers have become more lenient. Employees' spouses and children are not included in the 75% participation requirement.

Small group premiums can be increased as much as 66% from the lowest available premium to the highest available premium based on the size of the group, the group demographics, and health history of the applicants.

Group coverage will be more comprehensive than coverage in the individual and family market. Group coverage will include maternity benefits, mental health benefits and prescription benefits with minimal restrictions.

Continuation of coverage is available for employees who leave a company's employment. If the number of employees is less than 20, additional coverage is available through the State Continuation of Coverage. If the number of employees is greater than 20 then C.O.B.R.A. rules will apply.
